Terms of Use
These terms of use ("Terms") govern your access to and use of Omnibooking and any related services, features, or content provided by Omnibooking (collectively referred to as the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.
1. Use of the Service
1.1 Eligibility
You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years old.
1.2 License
Subject to these Terms, Omnibooking grants you a limited, non-exclusive, non-transferable, and revocable license to use the Service for your personal or internal business purposes.
1.3 Prohibited Activities
You agree not to engage in any of the following prohibited activities:
- Use the Service for any illegal or unauthorized purpose;
- Modify, adapt, or hack the Service, or otherwise attempt to gain unauthorized access to the Service or its related systems or networks;
- Interfere with or disrupt the integrity or performance of the Service or its components;
- Reverse engineer, decompile, or disassemble any part of the Service;
- Use the Service in any manner that could damage, disable, overburden, or impair the Service or interfere with any other party's use of the Service;
- Use any robot, spider, site search/retrieval application, or other automated device, process or means to access, retrieve, scrape, or index any portion of the Service;
- Frame or mirror any part of the Service without Omnibooking's express prior written consent;
- Violate any applicable laws or regulations.
2. User Accounts
2.1 Account Creation
In order to access certain features of the Service, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
2.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify Omnibooking immediately of any unauthorized use of your account or any other breach of security.
2.3 Account Deletion
Accounts failing to meet the requirements of the Terms may be deleted at anytime under Omnibooking's discretion.
2.4 Account Verification
You are responsible for verifying the authenticity of your account by either confirming through the built in email verification process or by directly notifying Omnibooking. Failure to verify your account within 30 days will make your account subject to deletion.
3. Intellectual Property
3.1 Ownership
Omnibooking retains all right, title, and interest in and to the Service, including all intellectual property rights therein.
3.2 User Content
By using the Service, you may submit, post, or display content, including but not limited to text, images, and other materials ("User Content"). You retain ownership of any intellectual property rights that you hold in the User Content. By submitting, posting, or displaying User Content, you grant Omnibooking a non-exclusive, royalty-free, worldwide, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the Service.
4. Privacy
4.1 Privacy Policy
Our collection and use of your personal information in connection with the Service are governed by our Privacy Policy. By using the Service, you consent to such collection and use.
5. Refunds and Cancellations
5.1 Refunds
Omnibooking offers refunds for purchased subscriptions under the following conditions:
- Payment transaction was within 48 hours of the refund request.
- None of the features available or services provided are currently in use.
- User is in full compliance with the rest of these Terms.
5.2 Cancellations
Users can cancel anytime and receive the full benefits of the purchased subscription service up until the end of the paid subscription period. After which the User's account will be downgraded accordingly.
This refund policy is only available for our subscription services available in the Omnibooking dashboard. Services negoitated between Omnibooking and the User will have different terms provided upon agreement.
6. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. Omnibooking disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
7. Limitation of Liability
To the fullest extent permitted by applicable law, Omnibooking shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service.
8. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles.
9. Changes to the Terms
Omnibooking reserves the right to modify or revise these Terms at any time, effective upon posting of the updated Terms on the Service. Your continued use of the Service after any such changes will constitute your acceptance of such changes.
10. Miscellaneous
10.1 Entire Agreement
These Terms constitute the entire agreement between you and Omnibooking regarding your use of the Service and supersede all prior or contemporaneous understandings and agreements, whether oral or written.
10.2 Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions of these Terms will remain in full force and effect.
10.3 Waiver
The failure of Omnibooking to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
11. Fraudulent Use and Impersonation
11.1 Impersonation of Business Entities
You agree not to use the Service to impersonate any business entity that you are not authorized to represent. Any such fraudulent use, including but not limited to creating accounts or submitting information under false pretenses, is strictly prohibited and constitutes a breach of these Terms.
11.2 Reporting Fraudulent Activity
If you become aware of any unauthorized or fraudulent use of the Service, you agree to report it immediately to Omnibooking. You can report such activities by contacting us at [email protected].
11.3 Consequences of Fraudulent Use
Omnibooking reserves the right to take appropriate legal action against individuals or entities found to be engaging in fraudulent activities, including but not limited to suspending or terminating accounts, pursuing civil or criminal charges, and cooperating with law enforcement agencies.
12. Anti-Spam Policy
12.1 Prohibition of Spam
You agree not to use the Service to send unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or any other form of solicitation. Any such activity is strictly prohibited and constitutes a breach of these Terms.
12.2 Prevention Measures
Omnibooking employs various measures to prevent, detect, and mitigate spam activities. These measures may include monitoring user activity, employing filtering technologies, and taking action against accounts suspected of engaging in spam.
12.3 Reporting Spam
If you receive any spam or suspect that any user is engaging in spam activities through the Service, you agree to report it immediately to Omnibooking. You can report such activities by contacting us at [email protected].
12.4 Consequences of Spamming
Omnibooking reserves the right to take appropriate action against individuals or entities found to be engaging in spam activities, including but not limited to suspending or terminating accounts, pursuing civil or criminal charges, and cooperating with law enforcement agencies.
